El presente artículo revisa las etapas por las que transitó el Estado chileno a partir de la década de 1930, particularmente en relación a las mutaciones del rol que desempeñó en la conducción de la economía nacional, y el impacto de aquellos cambios en la vinculación entre partidos políticos y sociedad, o en un sentido más amplio, entre Estado y nación. Observamos dos etapas claramente diferenciadas, la primera caracterizada por la constitución del Estado en pieza clave del modelo de desarrollo (...) económico e importante organizador de la sociedad, tarea -esta última- propiciada por la acción mediadora de los partidos políticos, los cuales establecieron profundos lazos con diversas organizaciones sociales, permitiendo la canalización de demandas y la distribución de beneficios. La segunda etapa, que se empieza a desarrollar a partir del quiebre democrático de 1973, muestra el repliegue del Estado y la imposición del mercado como eje central del modelo económico y como principal mecanismo de distribución de bienes y servicios. El retorno a la democracia -en 1990- estuvo marcado por esta realidad “mercado-céntrica” y por la nueva estructura institucional ideada durante la dictadura militar, lo que moldeó la reestructuración de sistema de partidos y obligó a cambiar las estrategias de interacción entre partidos políticos y sociedad, privilegiándose el marketing político y la utilización de medios de comunicación masivos por sobre la relación directa con las disminuidas organizaciones sociales. Esta revisión histórica puede ayudar a entender la actual crisis de representación y participación que se observa en Chile. (shrink)

Survey-based research on consumer attitudes towards farm animal welfare has increased. However, the geographical coverage of studies on consumer attitudes and perceptions about farm animal welfare has mostly been limited to Europe, and North America. Until (...) now, Latin American consumers’ attitudes towards animal welfare have not been well studied. Despite the fact that Mexico, Chile and Brazil belong to the same region, there are marked differences between these countries in terms of their economical and geographical characteristics among other factors. Those differences potentially have an impact on consumer attitudes towards animal welfare and livestock production systems in general. Given the evidence from the literature review, it seems advisable that Latin American producers and food industry who engage in animal welfare-enhancing practices should clearly label their products with information on the type of husbandry system to reach those consumers who want to make an informed choice. Therefore, there are some aspects that need to be studied and cannot be worked separately in order to promote and understand consumer attitudes towards dairy and beef systems, such as geography, economic development, and politics. En este artículo buscamos explicar lo que llamamos “la nueva preponderancia de la dimensión política en las relaciones internacionales”, entendiendo por aquello la creciente importancia que han adquirido últimamente tanto los actores políticos como el apostar por estrategias multidimensionales en política exterior –en contraposición a estrategias unidimensionales basadas en el contractualismo económico-comercial-, para tratar de dar respuesta a las inquietantes y complejas interrogantes que presenta el actual escenario mundial. La tesis del trabajo es que esta “vuelta a la política” en (...) el plano internacional se explica por la confluencia de dos fenómenos-procesos: por un lado el cambio de ciclo económico –propulsado en gran parte por la crisis financiera global-, que implica el inicio de lo que el economista inglés Robert Skidelsky llama ciclo “liberal-keynesiano”, y por otro lado la transformación del sistema internacional y el paso a lo que el académico estadounidense Richard Haass llama “la era de la no polaridad”. En el presente artículo me propongo, en primer lugar, exponer los aspectos que determinan una polaridad y un contraste entre lo bello y lo sublime a lo largo del siglo XVIII. En segundo lugar, mostrar que esa tensión constante no implicó una oclusión, contradicción, o superación de una estética respecto de otra. Por último, intentaré dar cuenta de los alcances éticos que fue adquiriendo lo sublime, lo cual permite pensar esta noción como un sentimiento espiritual-moral de reunificación y elevación (...) que trasciende las fronteras del gusto y lo meramente bello. In this paper, firstly, I propose to show the aspects that determine a polarity and a contrast between the beautiful and the sublime throughout the 18th century. Secondly, I will maintain that this constant tension did not mean an occlusion, contradiction, or overcoming of an aesthetic on the other. Finally, I will try to account of the ethical scope was acquiring the sublime, which suggests this notion as a spiritual-moral feeling of reunification and elevation beyond the boundaries of taste and the merely beautiful. In light of the enormous suffering brought about by war, war might be justified only if the benefit it yields is significant enough, namely, a clear and durable victory over the enemy. The logic of this argument leads to a Clausewitz-style war of “annihilation.” I argue that the best way to justify the ending of war short of such annihilation is by relying on a contractarian view of jus ex bello. I conclude by exploring the implications of this view (...) to warfare in which no effective social contract is in place. (shrink)

According to a widespread view, the same constraints that limit the use of otherwise immoral measures in individual self-defense apply to collective self-defense too. I try to show that this view has radical implications at the level of jus in bello, implications which have not been fully appreciated. In particular, if the necessity condition must be satisfied in all cases of killing in war, then most fighting would turn out to be unjust. One way to avoid this result is (...) to adopt a contractualist view of killing in war, a view which interprets the necessity condition in a way that is more permissive with regard to killing combatants in war. At least in this respect, a contractualist view of killing in war has an advantage over other candidates in explaining how wars might be fought justly. (shrink)

This essay argues that Aquinas's position regarding the killing of innocent people differs significantly from other representatives of the Christian just war tradition. While his predecessors, notably Augustine, as well as his successors, from Cajetan and Vitoria onward, affirm the legitimacy of causing the death of innocents in a just war in cases of necessity, Aquinas holds that causing the death of innocents in a foreseeable manner, whether intentionally or indirectly, is never justified. Even an otherwise legitimate act of just (...) war cannot legitimate causing the death of innocent people, as this can never advance the common good. This stance also contrasts sharply with much modern and contemporary double effect theorizing in relation to jus in bello. In this regard, Aquinas's position, shaped decisively by his biblical and theological commitments, may point the way towards an ethical orientation beyond the typical divisions of “pacifism” and “just war.”. Yitzhak Benbaji and Daniel Statman present a new theory on the ethics of war which shows that wars can be morally justified at both the ad bellum level and the in bello level.

Sobre la belleza humana pesa, en el reino de las artes visuales contemporáneas, casi una prohibición tácita. El cuerpo humano es todavía uno de los temas centrales del arte, pero no se lo suele representar como bello: el énfasis se pone en su fealdad, o en los aspectos terribles o abyectos de la corporalidad. Este artículo intenta comprender el proceso que lleva a esta situación a partir de la transformación del concepto de “belleza ideal” entre Kant y Baudelaire, que (...) muestra una profunda conexión entre el concepto de belleza humana y la esperanza del progreso moral. La ruptura de esta esperanza, sostenemos, es una de las razones por las cuales el arte moderno y contemporáneo ha rechazado con tanta fuerza la representación de la belleza ideal. (shrink)

Cosmopolitan War is characterized by a tension between moral demandingness and moral permissiveness. On the one hand, Fabre is strongly committed to the value of each and all human beings as precious individuals whose value does not depend on their national or other affiliation. This commitment leads to serious constraints on what may be done to others in both individual and national self-defense. Yet the book is also unambiguously permissive. It opens the gate to far more wars than traditional just (...) war theory would ever permit, in particular to what Fabre has dubbed ‘subsistence wars’, and it rejects the most fundamental constraint imposed by traditional jus in bello, namely, the prohibition against the deliberate killing of civilians. While both the demanding and the permissive aspects of the book seem troublesome to me, the latter seem more so and most of my paper is devoted to a critical examination of them. In the last part of the paper, I point to a different outlook to the one defended in the book and try to show that this outlook is less foreign to Fabre’s outlook than one might expect. (shrink)

A recent empirical study has argued that experts in the ethics or the law of war cannot reach reasonable convergence on dilemmas regarding the number of civilian casualties who may be killed as a side effect of attacks on legitimate military targets. This article explores the philosophical implications of that study. We argue that the wide disagreement between experts on what in bello proportionality means in practice casts serious doubt on their ability to provide practical real-life guidance. En la página 52 de su autobiografía Mi vida en la música Daniel Barenboin afirma no compartir la filosofía de Glenn Gould para quien la grabación es la única manera de producir música en el futuro. Baremboin define a su filosofía de la música un ¿naturalismo¿ para el que la música es sinónimo de vida, y lo que la singulariza es el tiempo, y el tiempo es lo que se pierde y jamás vuelve. El tiempo es lo que se (...) pretende expulsar de una sala de grabación. La música es tiempo y, por lo tanto no repetición, el metrónomo sólo repite la medida. A las notas las sigue el silencio sin el cual no existirían, y la duración del sonido es por eso intermitente, finita, mortal. Este efecto de vacío es también marcado en el mundo del lenguaje. Foucault decía que desde el punto de vista ¿arqueológico¿ los discursos son escasos, que lo que primero debe llamarnos la atención es la rareza de su existencia. Por eso mismo el sentido es también escaso, no constituye una abundancia que los hermeneutas deben interpretar. Así como hay más palabras que sentido, hay menos palabras que cosas, y en este orden de las carencias no olvidemos la primera lección de la economía política que define al ¿bien¿ por su rareza. El sonido es, entonces, una isla en un mar de silencio. Pero no fue sin duda este pequeño parágrafo en el libro de Barenboin lo que me marcó un interrogante llamado Gould. Hubo, además, una mención en la misma página referida a la muerte de Gould que le había impedido comparar las distintas versiones de sus Variaciones de Goldberg. Es posible que una cierta curiosidad por los espíritus trágicos haya detenido mi atención. (shrink)

“X-Firsters” hold that there is some normative feature that is fundamental to all others (and, often, that there’s some normative feature that is the “mark of the normative”: all other normative properties have it, and are normative in virtue of having it). This view is taken as a starting point in the debate about which X is “on first.” Little has been said about whether or why we should be X-Firsters, or what we should think about normativity if we aren’t (...) X-Firsters. Hence the chapter’s two main goals. First, to provide a simple argument that one shouldn’t be an X-Firster about the normative domain, which starts with the observation that analogous views have dubious merits in analogous domains. Second, to offer an alternative view—taking normativity to be a determinable explained in terms of its determinates—that offers an interesting way to think about the structure and unity of normativity. Supporters of open borders sometimes argue that the state has no pro tanto right to restrict immigration, because such a right would also entail a right to exclude existing citizens for whatever reasons justify excluding immigrants. These arguments can be defeated by suggesting that people have a right to stay put. I present a new form of the exclusion argument against closed borders which escapes this “right to stay put” reply. I do this by describing a kind of exclusion that (...) has not been discussed in depth, which I call “territorial exclusion.” Territorial exclusion is the process according to which the group that wishes to exclude current citizens secedes from the territory in which those citizens reside. I argue that the wrongness of territorial exclusion explains why there is no pro tanto right for a state to exclude immigrants, because otherwise there would be a pro tanto right for the state to kick people out by seceding from the territory they inhabit. Because kicking people out like this is typically wrong, borders cannot be closed. (shrink)

The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. Motion—and, in particular, local motion or change in location—plays a central role in Kenelm Digby’s natural philosophy and in his arguments for the immateriality of the soul. Despite this, Digby’s account of what motion consists in has yet to receive much scholarly attention. In this paper, I advance a novel interpretation of Digby on motion. According to it, Digby holds that for a body to move is for it to divide from and unify with other bodies. This is a view (...) of motion—as change in relations of parthood—that Alison Peterman attributes to Digby’s contemporary and acquaintance, Margaret Cavendish. Having shown that Digby’s presentation of the view predates Cavendish’s by more than a decade, I make a case that Digby’s work influenced Cavendish’s on this topic. In developing and defending my reading, I consider to what extent the Digbean account of motion and the arguments for it accord with the ideals of the mechanical philosophy emerging in the early modern period. I ask you to X. You now have a reason to X. My request gave you a reason. How? One unpopular theory is the epistemic account, according to which requests do not create any new reasons but instead simply reveal information. For instance, my request that you X reveals that I desire that you X, and my desire gives you a reason to X. Peter Schaber has recently attacked both the epistemic account and other theories of the reason-giving force of (...) requests. Schaber defends a new theory of the reason-giving force of requests according to which request give reasons because it is valuable for requesters and requestees that requests have this power. In this paper I argue that Schaber's attack on the epistemic account fails, and that his own theory ought to be rejected because it faces compelling objections. (shrink)

El presente trabajo desarrolla y discute el concepto de dualidad ontológica cristiana a la luz de la filosofía política de Francisco Bilbao y Jacques Maritain, analizando las condiciones que para cada autor posibilitan la convivencia entre el mundo cristiano y las sociedades democráticas. Se sostiene que, en función de su proyecto liberal, el chileno desfigura los elementos centrales del cristianismo para desarrollar una antropología que reduce a la persona a su dimensión puramente histórica y temporal. Asimismo, proponemos que la reacción (...) personalista de Maritain pretende ser una respuesta tanto al liberalismo que representara Bilbao como al problema de la religión dentro del espacio público. Plato's dialogues frequently criticize traditional Greek myth, yet Plato also integrates myth with his writing. Daniel S. Werner confronts this paradox through an in-depth analysis of the Phaedrus, Plato's most mythical dialogue. Werner argues that the myths of the Phaedrus serve several complex functions: they bring nonphilosophers into the philosophical life; they offer a starting point for philosophical inquiry; they unify the dialogue as a literary and dramatic whole; they draw attention to the limits of language and the limits (...) of knowledge; and they allow Plato to co-opt cultural authority as a way of defining and legitimating the practice of philosophy. Platonic myth, as a species of traditional tale, is thus both distinct from philosophical dialectic and similar to it. Ultimately, the most powerful effect of Platonic myth is the way in which it leads readers to participate in Plato's dialogues and to engage in a process of self-examination. (shrink)

This book is a study of the role of intellect in human action as described by Thomas Aquinas. One of its primary aims is to compare the interpretation of Aristotle by Aquinas with the lines of interpretation offered in contemporary Aristotelian scholarship. The book seeks to clarify the problems involved in the appropriation of Aristotle's theory by a Christian theologian, including such topics as the practical syllogism and the problems of akrasia. Westberg argues that Aquinas was much closer to Aristotle (...) than is often recognized, and he puts forward important new interpretations of the relation of intellect and will in the stages of intention, deliberation, decision, and execution. In the concluding section of the book, he shows how this new interpretation yields fruitful insights on a range of theological topics, including sin, law, love, and the moral virtues. (shrink)

Can a liberal state exclude illiberal immigrants in order to preserve its liberal status? Hrishikesh Joshi has argued that liberalism cannot require a commitment to open borders because this would entail that liberalism is committed to its own demise in circumstances in which many illiberal immigrants aim to immigrate into a liberal society. I argue that liberalism is committed to its own demise in certain circumstances, but that this is not as bad as it may appear. Liberalism’s commitment to its (...) own demise is merely a reflection of the fact that it must take into account the rights of outsiders, not just the rights of existing citizens, and of the fact that circumstances of injustice can sometimes leave liberal societies with no correct choice. Abstract This paper offers an appraisal of Phillip Pettit's approach to the problem how a merely finite set of examples can serve to represent a determinate rule, given that indefinitely many rules can be extrapolated from any such set. I argue that Pettit's so-called ethnocentric theory of rule-following fails to deliver the solution to this problem he sets out to provide. More constructively, I consider what further provisions are needed in order to advance Pettit's general approach to the problem. I (...) conclude that what is needed is an account that, whilst it affirms the view that agents' responses are constitutively involved in the exemplification of rules, does not allow such responses the pride of place they have in Pettit's theory. Este trabajo tiene el objetivo de mostrar que actualmente la bioética, si bien requiere de la aplicación de conocimientos de disciplinas heterogéneas, afronta diversas polémicas que tienen una estructura filosófica. Para sustentar una perspectiva filosófica como problema central, el método de abordaje de la presente propuesta contempla un análisis acerca del tipo de indagaciones que caracterizan a la bioética, la delimitación del objeto que estudia, las propuestas metodológicas más relevantes y aquellas alternativas de búsqueda que pretenden tomar distancia de la (...) reflexión filosófica, paralelamente a las variadas conceptualizaciones que parten de la moral y desembocan en la casuística. El argumento central es que la bioética atiende a incertidumbres morales que surgen en la interacción con la vida, estas son el objeto sobre el que reflexiona la ética, y si la ética es una disciplina que se resuelve apelando a los métodos de la filosofía, con este trabajo se pretende concluir que la bioética necesariamente ha de tener una estructura filosófica. The closely related debates concerning abortion, the protection of the embryo and stem cell science have captured the legislative agenda in Mexico in recent years. This paper examines some contemporary debates related to stem cell science and the legal and political action that has followed in the wake of the latest Supreme Court judgment on abortion, which debates are directly linked to the degrees of protection of the embryo stipulated in the Mexican Constitution. While some Mexican states have opted to (...) take no further action, others, where conservative political forces are in the majority, have been very active in seeking to ensure that their constitutions are amended to protect human life from conception onwards. This intense legislative activity has not, however, been repeated at the federal level, where there is currently no overarching national regulatory framework governing stem cell research. Although major efforts have been made by the conservative block within the Senate to bring forward legislative proposals for the prohibition of human embryonic stem cell research, and despite the public expression by the federal government of its commitment to encourage inward investment and innovation in the area of biotechnology, stem cell science has, so far, remained unregulated. The legislative challenge is to resist the pressure that has been injected by religious leaders and to act in accordance with the values and principles adopted by the community in the Mexican Constitution. In the final analysis, Mexico faces particular difficulties in accommodating conservative political forces on one hand, while recognising on the other its need, as an emerging economy, to promote a progressive approach to innovation in biotechnology. El objetivo de este trabajo es exponer los resultados de una intervención docente diseñada para la enseñanza de la filosofía en el nivel medio superior. Aquí se sostiene que el problema social de la violencia y el conflicto puede ser aminorado si se educa a las nuevas generaciones para el diálogo, y más aún para el diálogo filosófico. A partir de este supuesto se diseñó y se puso en marcha una propuesta didáctica basada en el aprendizaje colaborativo y en un (...) concepto de diálogo entendido como un intercambio argumentativo entre los participantes, orientado a una meta para la construcción colectiva de sentido. Se expone de manera general el problema que se avizora en la sociedad contemporánea, para después explicar los principios teóricos que se adoptaron para la planeación didáctica, finalmente se dan a conocer los resultados de la experiencia que se llevó a cabo a través de recursos digitales en el contexto de la pandemia por Covid-19. Se observa que a pesar de los límites que impone la educación a través de la pantalla, el estudiantado se apropia de los contenidos filosóficos, y además pone en juego sus habilidades para dialogar, argumentar y construir en común. Suppose one hundred prisoners are in a yard under the supervision of a guard, and at some point, ninety-nine of them collectively kill the guard. If, after the fact, a prisoner is picked at random and tried, the probability of his guilt is 99%. But despite the high probability, the statistical chances, by themselves, seem insufficient to justify a conviction. The question is why. Two arguments are offered. The first, decision-theoretic argument shows that a conviction solely based on the statistics (...) in the prisoner scenario is unacceptable so long as the goal of expected utility maximization is combined with fairness constraints. The second, risk-based argument shows that a conviction solely based on the statistics in the prisoner scenario lets the risk of mistaken conviction surge potentially too high. The same, by contrast, cannot be said of convictions solely based on DNA evidence or eyewitness testimony. A noteworthy feature of the two arguments in the paper is that they are not confined to criminal trials and can in fact be extended to civil trials. (shrink)

According to ethical objectivism, what a person should do depends on the facts, as opposed to their perspective on the facts. A long-standing challenge to this view is that it fails to accommodate the role that norms play in guiding a person’s action. Roughly, if the facts that determine what a person should do lie beyond their ken, they cannot inform a person’s deliberations. This paper explores two recent developments of this line of thought. Both focus on the epistemic counterpart (...) to ethical objectivism, according to which what a person should believe depends on the facts, as opposed to their perspective on the facts. The suggestion in each case is that epistemic objectivism faces a distinctive problem in accommodating guidance. Insofar as objectivism concerning the epistemic domain stands or falls with objectivism concerning the ethical domain, this is a problem for objectivism more generally. In this paper, I show that those arguments are not successful. The upshot is that the objectivist – whether ethical or epistemic – need not reject the idea that norms serve a guiding function. This essay considers the critical response to Hegel's view of Socrates we find in Kierkegaard's dissertation, The Concept of Irony. I argue that this dispute turns on the question whether or not the examination of particular thinkers enters into Socrates’ most basic aims and interests. I go on to show how Kierkegaard's account, which relies on an affirmative answer to this question, enables him to provide a cogent defence of Socrates' philosophical practice against Hegel's criticisms.

Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. La institucionalización de las Guardias Nacionales en América Latina durante el siglo xix formó parte de aquellas políticas republicanas tendientes a la construcción del monopolio de la fuerza. El presente artículo indaga este proceso en las denominadas provincias del Cauca, en el actual suroccidente colombiano. The literature on algorithmic fairness has examined exogenous sources of biases such as shortcomings in the data and structural injustices in society. It has also examined internal sources of bias as evidenced by a number of impossibility theorems showing that no algorithm can concurrently satisfy multiple criteria of fairness. This paper contributes to the literature stemming from the impossibility theorems by examining how informational richness affects the accuracy and fairness of predictive algorithms. With the aid of a computer simulation, we (...) show that informational richness is the engine that drives improvements in the performance of a predictive algorithm, in terms of both accuracy and fairness. The centrality of informational richness suggests that classification parity, a popular criterion of algorithmic fairness, should be given relatively little weight. But we caution that the centrality of informational richness should be taken with a grain of salt in light of practical limitations, in particular, the so-called bias-variance trade off. (shrink)

Smith argues that, unlike other forms of evidence, naked statistical evidence fails to satisfy normic support. This is his solution to the puzzles of statistical evidence in legal proof. This paper focuses on Smith’s claim that DNA evidence in cold-hit cases does not satisfy normic support. I argue that if this claim is correct, virtually no other form of evidence used at trial can satisfy normic support. This is troublesome. I discuss a few ways in which Smith can respond.
